Your Three-Phase Journey
All MindedGrowth® engagements follow a diagnostic-driven methodology designed to deliver personalized, evidence-based results:
Phase 1: Diagnostic Assessment (Days 1–3)
- Upon signing the engagement agreement and payment, clients receive immediate access to the MindedGrowth® Accountability Intelligence Diagnostic, a proprietary assessment tool that:
- Evaluates 5 core accountability domains (Directional Clarity, Operational Architecture, Cognitive Ownership, Emotional Endurance, Environmental Integrity)
- Identifies behavioral patterns, emotional triggers, and cognitive belief systems
- Generates a personalized profile and archetype (e.g., Strategic Procrastination, Efficient Drift, Perfection Paralysis)
- Provides an evidence-based protocol tailored to your specific bottleneck
Completion of the diagnostic is mandatory and must be done within 7 days of payment.
Failure to complete the assessment within this timeframe may result in engagement postponement or cancellation without refund of the 40% pre-work fee.
Phase 2: Strategic Customization (Days 4–7)
Using diagnostic results, MindedGrowth conducts:
- In-depth analysis of your accountability profile
- Goal breakdown into actionable daily tasks aligned with your cognitive patterns
- Schedule optimization identifying time blocks for goal work
- Protocol customization based on archetype and domain scores
- Preparation of personalized frameworks and implementation roadmap
This strategic preparation constitutes the 40% non-refundable pre-work fee and represents significant intellectual labor regardless of whether mentoring sessions proceed.
Phase 3: Tailored mentoring delivery
1-2-1 structured mentoring focused on:
- Implementing the customized accountability protocol
- Building sustainable habits and routines
- Real-time troubleshooting and adjustment
- Progress tracking against diagnostic baseline
What's Included (And What's Not)
Our Services Cover:
- Breaking down complex goals into executable daily tasks
- Developing productive habits and accountability systems
- Optimizing schedules to create protected time for priority work
- Building self-regulation and follow-through capacity
Explicitly Outside Our Scope:
- Ongoing task management or execution beyond the engagement period
- Business strategy, financial planning, or investment advice
- Technical implementation, project management, or operational execution
- Crisis intervention, therapy, or clinical mental health treatment
- Legal, HR, or regulatory compliance guidance
How We Communicate
- Scheduled sessions: Primary engagement channel (frequency agreed in contract)
- Email communication: Responses within 48 business hours for administrative matters only
- Between-session support: Limited to brief check-ins related to implementation of the agreed protocol
- Diagnostic support: One-time technical assistance if issues arise completing the assessment
- Out-of-scope requests: Will be flagged and may require separate engagement or referral
Changing the Scope
Any requests beyond the agreed scope require:
- Written request specifying the additional work needed
- Written approval from MindedGrowth with revised timeline and fees
- Executed amendment to the original agreement
Additional sessions, extended mentoring, or supplementary assessments will be quoted separately and are not included in the base engagement fee.
Your Responsibilities
To ensure engagement effectiveness, you commit to:
Diagnostic Completion
- Complete the MindedGrowth® Accountability Intelligence Diagnostic within 7 days of payment
- Answer all questions honestly and thoughtfully (results quality depends on input accuracy)
- Provide valid contact information for results delivery
Session Attendance & Preparation
- Attend all scheduled mentoring sessions on time
- Come prepared with progress updates and implementation questions
- Provide at least 14 days' notice for rescheduling (per cancellation policy)
Implementation & Honest Reporting
- Make good-faith efforts to implement the customized protocol
- Report progress accurately, including both successes and struggles
- Share relevant context that may impact implementation (schedule changes, unexpected events, etc.)
Professional Communication
- Communicate respectfully and courteously at all times
- Respond to reasonable requests for information within agreed timeframes
- Respect boundaries regarding communication channels and response times
Unacceptable Conduct
MindedGrowth will not tolerate:
- Abusive, threatening, harassing, or discriminatory behavior
- Dishonesty in diagnostic responses or progress reporting that undermines the engagement
- Repeated failure to attend sessions without proper notice
- Attempts to record sessions without explicit written consent
- Sharing, reproducing, or distributing proprietary materials without authorization
- Requests to engage in unethical, illegal, or fraudulent activities
When We May Terminate
MindedGrowth reserves the right to terminate an engagement immediately, without refund, for:
- Abusive or threatening behavior toward MindedGrowth staff or representatives
- Material misrepresentation in diagnostic responses or engagement communications
- Refusal to complete the diagnostic after 7-day deadline (following one written reminder)
- Repeated no-shows (missing 2+ sessions without proper notice)
- Unauthorized use or distribution of proprietary materials
- Non-payment or payment disputes resolved in MindedGrowth's favor after good-faith negotiation
- Violation of confidentiality regarding MindedGrowth's proprietary methods or other clients
Our Process
If conduct concerns arise:
- Initial concern: MindedGrowth will raise the issue verbally during a session or via email
- Written warning: If behavior continues, a formal written warning will be issued specifying the concern and required corrective action
- Final action: If unresolved after warning, MindedGrowth may terminate immediately
Upon termination for cause:
- You remain liable for all fees for work completed to date
- The 40% pre-work fee is retained in full (diagnostic + customization already delivered)
- Any scheduled future sessions are cancelled without refund
- All access to proprietary materials is revoked
- You must immediately cease use of MindedGrowth frameworks and tools
Our Commitment to Your Wellbeing
MindedGrowth is committed to creating a psychologically safe, supportive environment for growth and development. However:
- Our services are performance coaching, not therapy. We do not provide clinical mental health treatment, crisis intervention, or therapeutic counseling.
- If you present with concerns beyond our scope (significant mental health symptoms, crisis, trauma), we will recommend appropriate professional resources and may pause or conclude the engagement in your best interest.
- We respect boundaries. If we observe signs that the engagement is causing harm or distress, we will address this openly and, if necessary, offer to transition you to more appropriate support.
Diagnostic Accuracy & Your Responsibility
The MindedGrowth® Accountability Intelligence Diagnostic generates personalized protocols based on your responses. The accuracy and effectiveness of results depend entirely on the honesty, thoughtfulness, and accuracy of your input.
You Acknowledge That:
- Diagnostic quality depends on input quality: Rushed, dishonest, or inaccurate responses will produce unreliable results and ineffective protocols
- "Garbage in, garbage out" applies: MindedGrowth cannot be held responsible for protocols that don't fit if diagnostic responses were inaccurate, incomplete, or dishonest
- Honest self-assessment is required: The diagnostic is designed to identify genuine accountability patterns, not to produce "good" scores or desirable archetypes
- Results are not fixed: Diagnostic results reflect your state during assessment and may change over time
We Are Not Responsible For:
- Protocols that are ineffective if responses were inaccurate
- Outcomes impacted by dishonest, rushed, or incomplete diagnostic completion
- Implementation challenges arising from inadequate or misleading self-assessment
- Time wasted on strategies that don't address actual bottlenecks due to response quality issues
Re-Assessment Option
If you complete the diagnostic inaccurately and receive a protocol that doesn't fit, you may request one re-assessment during the engagement at no additional charge. However:
- The 40% pre-work fee remains non-refundable regardless of re-assessment
- Re-assessment must be requested within the first week of mentoring
- Only one re-assessment is permitted per engagement
- MindedGrowth reserves the right to decline re-assessment if there is evidence of intentional misrepresentation
General Legal Terms
Severability
If any provision of this agreement is found to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, or if that is not possible, severed from this agreement. The remaining provisions shall continue in full force and effect.
Entire Agreement
This agreement, together with any attached schedules, appendices, or engagement-specific terms, constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, understandings, and agreements, whether written or oral.
Amendments
No amendment, modification, or waiver of any provision of this agreement shall be valid unless in writing and signed by both parties. Any proposed changes must be agreed upon before taking effect.
Waiver
The failure of either party to enforce any provision of this agreement shall not constitute a waiver of that provision or the right to enforce it in the future. All rights and remedies are cumulative.
Assignment
You may not assign, transfer, or delegate any rights or obligations under this agreement without MindedGrowth's prior written consent. MindedGrowth may assign this agreement to any successor entity in the event of a merger, acquisition, or sale of substantially all assets.
Notices
All notices, requests, and communications under this agreement must be in writing and delivered to the email addresses specified in the engagement agreement. Notices are deemed effective upon receipt or, if sent via email, 24 hours after sending (unless delivery failure notification is received).
Force Majeure
Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, labor disputes, governmental actions, pandemics, or failures of third-party infrastructure. If a force majeure event continues for more than 60 days, either party may terminate the agreement without liability.
Independent Contractor Status
MindedGrowth operates as an independent contractor. Nothing in this agreement creates a partnership, joint venture, employment, or agency relationship. Neither party has authority to bind the other or incur obligations on their behalf.
Governing Law & Jurisdiction
This agreement is governed by the laws of England and Wales. Both parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales for any disputes arising from or related to this agreement.
Mutual Respect & Good Faith
Both parties commit to:
- Operating with integrity, transparency, and mutual respect
- Communicating concerns proactively and constructively
- Honoring commitments and maintaining professional standards
- Recognizing that successful outcomes require collaborative effort and honest communication
By proceeding with MindedGrowth® services, you acknowledge understanding and acceptance of these Terms & Conditions.
